In the eighteenth-century England, the aesthetic vision of most contemporary writers of the time was closely related to the social, political and religious system of belief. Augustan writers, satirists particularly, sought to reclaim for literature the morally privileged status, they thought, it supposedly held in the context of the Latitudinarian system of thought; the very rationale behind the ethic of good nature that distinguishes major writings of the time, namely the dramatic, journalistic and fictional works of the major eighteenth century (...) novelist and satirist Henry Fielding. His major dramatic works not only display the influence of the Latitudinarian philosophy but mainly Shaftesbury’s moral theory of innate goodness, which Fielding revokes, offering then a representation of a more universal moral frame which rather reflects and criticizes the society of the author’s time. The providential pattern that Fielding creates in his plays valorizes indeed the principle of good-nature and the triumph of virtue against all apparent social evils. Most significantly, it has positioned Henry Fielding himself in a “comedic” tradition in which characters are not ultimately responsible for themselves. In the present paper, and with reference to Earl of Shaftesbury’s assumptions about the ideal good-natured man, I intend to evince that Fielding uses the value of good-nature and virtue not as pure moral abstractions, but rather as nodal points around which he organizes, and through which he presents a broad cultural and historical vision. With reference to his major regular comedies, and a through a close study of his most representative characters, I will attempt to evince that this underlying moral vision is more than an abstract rumination of the relative power of good and evil. When we view and consider such concepts as virtue, good-nature and ill-nature in the immediate contexts of his plays, we conceive a picture of a broad cultural landscape in which ethical values become nodal points of meaning, in which Fielding represents both the most basic, traditional values and the most sordid everyday events and attitudes of his society. The present research is an attempt to determine the contribution of the management system and the institutional framework to the efficiency of values-based management. The interest in the question of efficiency stems from the fact that to grasp this founding principle of management is essential for any effort of evaluation and valuation accompanying the adoption of any type of management. Our choice of an organizational variable as well as an environmental one to explain the phenomenon of efficiency, intends to cover (...) sources of influence, both internal and external to the organization. As such, this study addresses the following question: What is the effect of the management system and the institutional framework on the efficiency of values-based management? The main theoretical and empirical results reveal that these two variables contribute jointly to the efficiency of VBM. More precisely, the empirical results obtained, in particular through the canonical correlation analysis, specify that both variables influence the efficiency of VBM in different degrees, with the effect of the management system being superior. The latter explains the efficiency of the management by the values at a rate of 52.59 %, whereas the institutional framework explains it only up to 25.15 %. (shrink)

The “Averroism” of Ibn Ṭumlūs (d. 620/1223) has already been attested to by both biographers and textual evidence. Conversely, a close reading of a section in his Kitāb al-Qiyās of his Mukhtaṣar fī al-mantiq (Compendium on Logic) reveals that this “Averroism” has a specific resonance. Unlike Ibn Rushd (d. 595/1198), Ibn Ṭumlūs belongs to this group of philosophers who dedicated a special section to the examination of jurisprudential inferences, titled by him “al-Qawl fī al-maqāyīs al-fiqhiyyah”, which is a part of (...) his Kitāb al-Qiyās. In this article, first, I will introduce the text of Ibn Ṭumlūs, and present its teaching by placing it in its intellectual context, namely in the light of al-Fārābī’s, al-Ghazālī’s, and Ibn Rushd’s relevant texts. Then, I provide an English translation followed by a critical edition of the Arabic text. The purpose is to highlight the value (and limitations) of Ibn Ṭumlūs’s effort, based on al-Fārābī (d. 339/950), al-Ghazālī (d. 505/1111) and Ibn Rushd, to apply Aristotelian syllogistic model to the jurisprudential inferences. In a society transitioning to democracy from an authoritarian regime, drafting a new constitution is an important step in the establishment of a civil and democratic state. Indeed, the demand of Tunisians to write a new constitution reflects their ambitions, aspirations and hopes; but reality shows a huge gap between the expectations of the majority of Tunisians and the result of the drafting process. The Tunisian transition is characterized by a fierce debate between the secular and the religious forces. This (...) unfolding confrontation forms the backdrop to the process of drafting a new constitution, amid anxiety surrounding the place of Islam in the new political system. However, fears of the resurrection of a new theocratic dictatorship are mitigated by a dynamic civil society in which voices that were silenced or misused by the former regime of Zine Al-Abidine Ben Ali are becoming distinctly vocal. Their action has become increasingly visible, evolving around the place of religion, law and gender in the new constitutional framework. El artículo propone examinar cómo las polémicas islámicas anticristianas fueron encontradas, (...) utilizadas y cuestionadas, tanto por personajes librepensadores, como Stubbe y Toland, como por los estudiosos más ortodoxos. Para tal fin establece los distintos hábitos en la citación y utilización de la erudición “orientalista” que se emplearon entre 1650 y 1720, prestando especial atención a las grandes obras de Hotttinger y Pococke. El artículo argumenta que los librepensadores fueron perfectamente capaces de apropiarse de aspectos tanto de la erudición cristiana como de la teología islámica para sus fines antireligiosos. Most philosophers agree that causal knowledge is essential to decision-making: agents should choose from the available options those that probably cause the outcomes that they want. This book argues against this theory and in favour of evidential or Bayesian decision theory, which emphasises the symptomatic value of options over their causal role. It examines a variety of settings, including economic theory, quantum mechanics and philosophical thought-experiments, where causal knowledge seems to make a practical difference. The arguments make novel use of (...) machinery from other areas of philosophical inquiry, including first-person epistemology and the free will debate. We introduce a two-valued and a three-valued truth-valuational substitutional semantics for the Quantified Argument Calculus (Quarc). We then prove that the 2-valid arguments are identical to the 3-valid ones with strict-to-tolerant validity. Next, we introduce a Lemmon-style Natural Deduction system and prove the completeness of Quarc on both two- and three-valued versions, adapting Lindenbaum’s Lemma to truth-valuational semantics. We proceed to investigate the relations of three-valued Quarc and the Predicate Calculus (PC). Adding a logical predicate T to Quarc, true of (...) all singular arguments, allows us to represent PC quantification in Quarc and translate PC into Quarc, preserving validity. Introducing a weak existential quantifier into PC allows us to translate Quarc into PC, also preserving validity. However, unlike the translated systems, neither extended system can have a sound and complete proof system with Cut, supporting the claim that these are basically different calculi. (shrink)

The idea that the state ought to be neutral towards different conceptions of the good life has been an influential principle in liberal theory since the 1970s. It has, however, been subject to criticism by communitarians, multiculturalists and liberal perfectionists. Recently, Peter Balint has attempted to defend state neutrality against its liberal critics as the adequate interpretation of the liberal project by redefining it as a range concept. By arguing that neutrality always occurs within a specific range of permissible conceptions (...) of the good life, Balint provides a convincing rebuttal of neutrality’s critics. In this paper I argue that while neutrality as a range concept provides an adequate account of state neutrality, it also makes it vulnerable to a new line of critique. Since the range of neutrality cannot be deduced from the principle of neutrality itself, neutrality is subject to political developments beyond its own control. I will start by clarifying the notion of neutrality as a range concept. Secondly, I will demonstrate that Balint’s notion of the range concept finds ample support in the wider literature on neutrality. Thirdly, I will argue that, as a range concept, neutrality ultimately depends on politically constituted value judgments. (shrink)

Biobanking is a relatively new concept in Egypt. Building a good relationship with different stakeholders is essential for the social sustainability of biobanks. To establish this relationship, it is necessary to assess the attitude of different groups towards this concept. The objective of this work is to assess the knowledge, attitude, and opinions of Egyptian patients towards biobanking issues. We designed a structured survey to be administered to patients coming to the outpatient clinics in 3 university hospitals in Egypt. The (...) survey included questions estimating the level of knowledge about the term “Biobank”, together with questions about the attitudes and opinions about related issues. Two hundred and fifty-nine patients participated in the survey. Eighty-one percent of participants reported that they never heard about the term before. About 85% expressed that they would be willing to donate their samples for research and about 87% thought that sample donation did not contradict their religious beliefs. Fifty eight percent were willing to participate in a genetic research project, 27.8% supported sharing their sample with pharmaceutical companies, and 32.4% agreed to share their samples with institutions abroad. Although there is limited knowledge about biobanking among Egyptian patients, many had a positive attitude towards sample donation and didn’t show religious concerns against it. However, they showed concerns regarding participation in genetic research and with sharing their samples across borders or with pharmaceutical companies. Public education about biobanking is possible, taking into consideration the specific cultural and legal framework in Egypt. (shrink)

Probably many people have cyclic preferences: they prefer A to B, B to C and C to A for some objects of choice A, B and C. Recent work has resurrected the objection to cyclic preference that agents possessing them are open to exploitation by means of ‘money pumps’. The paper briefly reviews this work and proposes a general approach to problems of sequential choice that makes cyclic preference immune to exploitation by means of these new mechanisms.

Conventional wisdom suggests that environmental pragmatists balk at the mere mention of intrinsic value. Indeed, the leading expositor of the pragmatic position in environmental philosophy, Bryan Norton, has delivered withering criticisms of the concept as it has been employed by nonanthropocentrists in the field. Nevertheless, I believe that Norton has left an opening for a recognition of intrinsic value in his arguments, albeit a version that bears little resemblance to most of its traditional incarnations. Drawing from John Dewey’s contextual approach (...) toward moral inquiry, I offer a reconstructed notion of intrinsic value that avoids the metaphysical pitfalls identified by Norton. I argue that this contextual understanding of noninstrumental claims has the advantage of turning our attention toward, and not away from, the critical realm of practice and policy, and that it is especially compatible with the norms of democratic deliberation. By way of example and in defense of my position, I conclude with a rejoinder to Holmes Rolston’s claims about the role of foundational intrinsic value commitments in settling the human-nature dilemma at Royal Chitwan National Park in Nepal. This work introduces the framework for selecting architecture in 5G networks, considering various technological, performance, economic, and operational factors. With the emergence of 5G technology, the architecture selection process has become pivotal in meeting diverse requirements for ultra-high-speed connectivity, low latency, scalability, and diverse service demands. The evaluation comprehensively analyses different architecture options, including centralized, distributed, cloud-based, and virtualized architectures. Factors such as network performance, scalability, cost-effectiveness, security, and compatibility are considered within a multi-criteria decision-making framework. Findings reveal each architecture (...) option's diverse strengths and limitations, emphasizing the importance of aligning architectural choices with specific use cases, deployment scenarios, and business objectives. We used the concept of multi-criteria decision-making (MCDM) methodology to control the various criteria. We used the single-valued neutrosophic set (SVNS) to deal with vague and inconsistent data. The SVNS is integrated with the hyperSoft set. The proposed methodology uses a single-valued neutrosophic hyperSoft set (SVNHSS) to select the best 5G architecture. We used the VIKOR method as an MCDM method to rank the alternatives. The proposed framework provides stakeholders with a structured methodology to evaluate and prioritize architecture options, facilitating informed decision-making in the complex landscape of 5G network deployments. The paper discusses Ian Wells’s recent argument that there is a decision problem in which followers of Evidential Decision Theory end up poorer than followers of Causal Decision Theory despite having the same opportunities for money. It defends Evidential Decision Theory against Wells’s argument, on the following grounds. Wells's has not presented a decision problem in which his main claim is true. Four possible decision problems can be generated from his central example, in each of which followers of Evidential Decision (...) Theory do at least as well as followers of Causal Decision Theory. There is another case in which followers of Causal Decision Theory have the same opportunities for making money but end up worse than followers of Evidential Decision Theory. (shrink)

I argue that we can visually perceive others as seeing agents. I start by characterizing perceptual processes as those that are causally controlled by proximal stimuli. I then distinguish between various forms of visual perspective-taking, before presenting evidence that most of them come in perceptual varieties. In doing so, I clarify and defend the view that some forms of visual perspective-taking are “automatic”—a view that has been marshalled in support of dual-process accounts of mindreading.

Burnout among health professionals is at epidemic proportions. In response, many health institutions have emphasised the importance of self-care, relying particularly on the idea that doctors who are burned out provide worse care for their patients. Although not made explicit, this suggests that doctors might have a responsibility to their patients (and perhaps others) to practice self-care. This chapter explores the potential grounds for such an obligation. We suggest that while there is potential for a limited obligation of self-care, institutional (...) emphasis on this risks instrumentalising doctors' well-being, minimising institutional responsibilities and workers' rights, and being excessively demanding for individuals. When is seeing part of an object enough to qualify as seeing the object itself? For instance, is seeing a cat’s tail enough to qualify as seeing the cat itself? I argue that whether a subject qualifies as seeing a given object varies with the context of the ascriber. Having made an initial case for the context-sensitivity of object-seeing, I then address the contention that it is merely a feature of the ordinary notion. I argue that the notions of object-seeing (...) that earn their explanatory keep in both vision science and the philosophy of perception are context-sensitive as well. (shrink)

I outline three conceptions of seeing that a creature might possess: ‘the headlamp conception,’ which involves an understanding of the causal connections between gazing at an object, certain mental states, and behavior; ‘the stage lights conception,’ which involves an understanding of the selective nature of visual attention; and seeing-as. I argue that infants and various nonhumans possess the headlamp conception. There is also evidence that chimpanzees and 3-year-old children have some grasp of seeing-as. However, due to a dearth of studies, (...) there is no evidence that infants or nonhumans possess the stage lights conception of seeing. I outline the kinds of experiments that are needed, and what we stand to learn about the evolution and development of perspective taking. (shrink)

We give a new characterization of the class of completely representable cylindric algebras of dimension 2 #lt; n ≤ w via special neat embeddings. We prove an independence result connecting cylindric algebra to Martin's axiom. Finally we apply our results to finite-variable first order logic showing that Henkin and Orey's omitting types theorem fails for Ln, the first order logic restricted to the first n variables when 2 #lt; n#lt;w. Bişr el-Merîsî taraftarları ile Osman ed-Dârimî arasında burada tartışma konusu yapılan hadisler haberî sıfatları konu alan ve müşkil nitelikte olan rivayetlerden oluşmaktadır. Bu rivayetleri genelde Bişr el-Merîsî ve taraftarlarının tecsîm ve teşbîh içerdiği iddiasıyla münker kabul ettikleri görülmektedir. Ehl-i re’y özellikleri taşımakla birlikte ilahî sıfatlar konusunda Mu’tezilî bir anlayışa sahip olduklarından tenzih anlayışları gereği sıfatları reddetmektedirler. Yaratılmışlara ait niteliklerin yaratıcıya nisbet edilmesini tenzîh anlayışlarına aykırı gördüklerinden bu tür müşkil rivayetleri ya kendi anlayışları doğrultusunda te’vîl ya da reddettikleri gözlenmektedir. Sert bir (...) ehl-i hadîs âlimi olan Osman ed-Dârimî ise, ayet ve hadislerde bildirilen ilahî sıfatlara iman edilmesi gerektiğini kabul etmektedir. Bu anlayışı sebebiyle bu rivayetlerde bildirilen haberî sıfatlara da te’vîl etmeksizin lafzî anlamıyla yaklaşmakta; kendi görüşü doğrultusunda Bişr el-Merîsî ve taraftarlarının yaptığı te’vîlleri reddetmekte, bu te’vîllerin ta’tîle yol açacağını ileri sürmektedir. Bu rivayetlerin lafzî (literal) anlamları doğrultusunda anlaşılması gerektiğini savunmaktadır. Bu hadisler üzerinde yapılan tartışmalar, temel hadis eserlerinin yazıldığı dönemde Ehl-i re’y ve Ehl-i hadîs ekollerine mensup âlimlerin hadislere yaklaşımlarını göstermesi bakımından önem arzetmektedir. Burada vermiş olduğumuz hadisler üzerindeki tartışmalar bu iki ekolün uluhiyet anlayışını, haberî sıfatlara yaklaşımlarını ortaya koyduğu gibi bunların genel anlamda hadis perspektifi hakkında bizlere bilgi vermektedir.ÖzetBu araştırma, temel hadis kitaplarının yazıldığı dönemde, yani III./IX asırda, haberî sıfatlar ihtiva eden bazı hadisler üzerinde yapılan tartışmaları ele almaktadır. İnceleme konusu yapılan hadisleri tartışan tarafları kısaca tanıtmak yerinde olacaktır. Sözünü ettiğimiz rivayetlerle ilgili tartışmalar Bişr el-Merîsî taraftarları ile Osman ed-Dârimî arasında geçmektedir. Ehl-i hadîs’in önemli simalarından biri olan Osman ed-Dârimî, hadislerle ilgili bu tartışmaları içeren ayrı bir eser yazmıştır. Bu eser, Allah’ın sıfatları ve bazı hadis meseleleri konusunda Bişr el-Merîsî ve onun iki talebesinin görüşlerine reddiye olarak yazılmıştır. Bişr el-Merîsî, Ebû Yusuf’tan (ö. 182/798) fıkıh tahsil etmiş, önemli bir kelâmcı olarak tanınmıştır. O, kelâmla ilgili konularda aralarında İmâm Şâfiî’nin (ö. 204/820) de bulunduğu pek çok âlimle ilmî tartışmalar yapmış bir ehl-i re’y âlimdir. Halife Me’mûn’un (ö. 218/833) danışma meclisinde bulunmuş, Kur’ân’ın yaratılmışlığı (Halku’l-Kur’ân) görüşünün benimsenmesinde önemli payı olmuştur. Osman ed-Dârimî ise, Yahyâ b. Ma’în (ö. 233/848), Ali b. Medînî (ö. 234/848-49), İshâk b. Râhûye (ö. 238/853) ve Ahmed b. Hanbel (ö. 241/855) gibi döneminin otoritelerinden hadis öğrenmiş bir ehl-i hadîs âlimidir. Hadis tahsili için önemli bütün şehirleri dolaşarak hadis öğrenmiş ve rivayette bulunmuştur.Haberi sıfatları ispat ve bunlarla ilgili rivayetlerin teviline karşı çıkan anlayış ile, bu rivayetlerin tenzih anlayışına uygun biçimde tevilini savunan kesimler ilk dönemden itibaren eserler telif etmişlerdir. Osman ed-Dârimî’ye göre, ehl-i hadîs’in eleştiri edebiyatının ortaya çıkmasında, Mu’tezile’nin ilahî sıfatları reddetmesi etkili olmuş ve pek çok müellif bu yönde eserler yazmışlardır. Ebû Hüreyre’den nakledilen bir rivayetle ilgili olarak muârız, bu rivayetin Allah için bildiğimiz göz ve kulak organlarından oluştuğu izlenimi verildiğini söyler. Osman ed-Dârimî, bu hadisin göz ve kulak organlarını değil görme ve işitmeyi ispat ettiğini söyler. Hiçbir konuda Allah’ın benzerinin bulunmadığını belirtir. Dolayısıyla Allah’ın organlardan oluştuğu iddiasını ehl-i hadîs’e nisbet etmek iftiradır. Ebû Dâvûd, bu hadis ile Allah için görme ve işitme sıfatlarının ispat edildiğini ve Cehmiyye’nin ilahî sıfatları inkar görüşüne reddiye olduğunu belirtir. Ebû Hüreyre’in Hz. Peygamber’e nispet ederek naklettiği: "İman Yemenlidir, hikmet Yemenlidir! Ben Rabbi’nizin nefesini Yemen tarafından hissediyorum!" rivayetini de muârız münker kabul etmiştir. Çünkü Bişr el-Merîsî ve ashâbına göre nefes ancak karın boşluğu olanlardan çıkar, Allah ise bundan münezzehtir. Osman ed-Dârimî’ye göre, muârız yanlış anlamıştır. Burada kastedilen, Yemen tarafından esen ve insanı rahatlatan rüzgardır. Bu rivayet bağlamında bakıldığında, Bişr el-Merîsî taraftarlarının rivayeti literal değerlendirdiğini, Osman ed-Dârimî’nin ise rivayeti yorumladığını görmekteyiz. İbnü’s-Selcî, "Siz, Allah’a ondan çıkandan (Kur’ân’dan) daha faziletli bir şeyle yaklaşamazsınız!" rivayeti hakkında, Müşebbihe’nin bunu, karın boşluğu olan, kendisinden kelâm çıkan şeklinde anladıklarını belirtir. Allah boşluğu olmayan anlamında "samed" olduğundan bu anlayış geçersizdir. Bu hadisle, Kur’ân’ın Allah’tan değil O’nun katından çıkması kastedilmiştir. Osman ed-Dârimî’ye göre, İbnü’s-Selcî’nin asıl maksadı Allah’ın kelâm sıfatını inkâr etmektir. Kur’ân’ın O’ndan çıktığında bir şüphe yoktur, bunu sadece kelâm sıfatını kabul etmeyenler inkâr etmektedir. İbn Abbâs’a atfedilen; "Rükn (Hacerülesved) yeryüzünde Allah’ın sağ elidir, halk ile onunla musafaha eder" rivayetinde geçen "yemînullah" (Allah’ın sağ eli) sözünün anlamı, İbnü’s-Selcî’ye göre bildiğimiz sağ el değil, Allah’ın nimeti ve ikrâmıdır. Hacerülesved ile elin kastedilmediğini kabul eden Osman ed-Dârimî’ye göre, İbnü’s-Selcî’nin maksadı, geçersiz te’villerle Allah hakkında ayet ve hadislerde belirtilen iki eli inkar etmektir. İbn Abbâs’ın Hz. Peygamber’den naklettiği başka bir rivayeti İbnü’s-Selcî’nin eserine alıp nakletmesini eleştiren Osman ed-Dârimî, bu tür zayıf rivayetlerin yayılmaması gerektiğini söyler. Buna ilave olarak İbnü’s-Selcî’nin yaptığı yorumun da çirkin olduğunu belirtir ve eleştirir. Çünkü sözü edilen rivayette Allah, yeşil bir takım elbise giymiş kıvırcık saçlı bir genç olarak tasvir edilmektedir. Böyle bir rivayet Hz. Peygamber’den gelen sahih rivayetlerle çeliştiği için de güvenilmez bir rivayettir. Rivayetle ilgili bu değerlendirmeyi yapan Osman ed-Dârimî, rivayet hakkında muârızın yaptığı yorumları da reddeder. Muârıza göre, "Rabbimin yanına girdim" sözü, "Adn cennetinde Rabbimin huzuruna girdim" demektir. Osman ed-Dârimî’ye göre bu gibi müşkil (problemli) hadisler re’y ile tefsir edilmemeli, rivayet edilip bırakılmalıdır. Hz. Peygamber’e dayandırılan ve Allah’ın kendisine geldiğinden bahisle cevabını bilemediği bazı sorulan sorduğundan, sonra Rabbinin elini sırtına koymasıyla parmaklarının serinliğini hissettiğinden ve her şeyi öğrendiğinden bahseden rivayetle ilgili olarak muarız şu değerlendirmede bulunur: Allah Resûlü’ne gelen Rabbi değil güzel suretli bir melekti, o melek Allah tarafından yönledrilmekteydi ve elini koyan da o melekti. Osman ed-Dârimî, muârızın bu yorumunu reddeder. Bu yorum aynı zamanda diğer sahih hadislere de aykırıdır. Osman ed-Dârimî, sözkonusu rivayet hakkında muârızın yorumunu reddettikten sonra zikrettiği sahih rivayetlere dayanarak buna güvenilemiyeceğini ifade etmiştir. İlahî sıfatlar hakkında konuşmak en zor konular arasında görüldüğünden, selef âlimleri bu konuda susmayı tercih etmişlerdir. Ancak sonraki nesiller bu konuda farklı yollar tutmuşlardır. İlahi sıfatları anlama konusundaki temel yaklaşımları tefvîz, teşbîh ve te’vîl şeklinde üç ana başlıkta toplamak mümkündür. Tefvîz, selef alimlerinin benimsediği yol olup, Allah’ın zâtı ve sıfatlarının mahiyetine ilişkin bilgiyi ilâhî ilme havale etmek demektir. Teşbîh, Allah’ı yaratılmışlara veya yaratılmışları Allah’a benzetmek anlamına gelir. Te’vil, Allah’ın yaratılmışlara benzediği izlenimini veren ayet ve hadisleri dil bilimi ve aklî bilgilerle yorumlamaktır. Sıfatları inkar edenlere Muattıla denilmiş, sıfatları ispat edenler Sıfâtiyye diye anılmıştır. Ehl-i re’y’e göre Allah’a atfedilen ve sözlük anlamı bakımından teşbîh ve tecsîm izlenimi veren sıfatları uygun biçimde te’vil etmek gerekir. İlâhî sıfatlarda Mu’tezile tenzihi öne çıkarmış, Eş’ariyye ve Mâtürîdiyye ise tenzihe uygun te’vili benimsemiştir. Müşebbihe, Vehhâbî-Selefî anlayış da ilahî sıfatlardaki lafızları zahiri anlamlarıyla almışlardır. Hadis ilminde en önemli temel eserlerin telif edildiği II./VIII. ve III./IX. asırda yaşamış olan âlimler arasında cereyan eden inceleme konusu yaptığımız tartışma, ilk döneme ait olması bakımından önemlidir. Bunun yanında tartışma, âyet ve hadislerden oluşan naslara yaklaşımda, iki temel yaklaşımı göstermesi bakımından da önemli bilgiler ihtiva etmektedir. Bu iki temel yaklaşımdan biri ehl-i re’y ekolünü, diğeri ise Ehl-i hadîs anlayışını temsil etmektedir. Osman ed-Dârimî genel olarak rivayetin lafzına bağlı kalmayı savunmakta, Bişr el-Merîsî ve ashâbı ise münker olduğu gerekçesiyle rivayeti eleştirmekte ya da te’vil etmektedir. Nadir de olsa Osman ed-Dârimî’nin rivayeti ret ya da te’vil ettiği, Bişr el-Merîsî ve ashâbının ise rivayeti savunduğu yerler de görülebilmektedir. Müteşâbih (problemli) rivayetler hakkında Bişr el-Merîsî’nin yaptığı te’viller sonraki âlimler üzerinde etkili olmuştur. Onun te’villeri, Cübbâî (ö. 303/916), Kādî Abdülcebbâr (ö. 415/1025), Ebü’l-Hüseyin el-Basrî (ö. 436/1044) gibi Mu’tezilî âlimlerin yanı sıra, İbn Fûrek, Gazâlî (ö.505/1111), İbn Akîl (ö. 513/1119), Fahreddîn er-Râzî (ö. 606/1210) gibi sünnî âlimler tarafından da iktibâs edilmiştir. Rivayete dayalı olan hadis ilminde hakikatin ortaya konulabilmesi, "rivayet" ve "re’y" seçeneklerinden birini tercih etmekle değil; bunların her ikisini de yerinde ve dengeli olarak kullanılmasına bağlı olduğunu hatırda tutmak gerekir. Hakikatin ortaya çıkarılmasında rivayet re’ye, re’y de rivayete muhtaçtır. Rivayet ve re’y birbirinin rakibi değil tamamlayıcı unsurları olarak görmek gerekir. (shrink)

The use of armed drones in post-9/11 US military conflicts has increasingly been the subject of academic writings; few, however, examine its collateral effects from a biopolitically-framed, phenomenological lens. This article examines how the indeterminate field of threat produced and sustained by the preventive military paradigm of drone warfare transforms potential threats into determinate targets of military violence. The spatial disruption experienced by inhabitants of the "space of death" generated by the "drone zone" thus transforms their existential comportment of living (...) under drones into that of 'walking corpses' whose relationships to space expose the devastating phenomenological consequences of drone warfare. To help ensure the ethical conduct of research, many have recommended educational efforts in research ethics to investigators and members of research ethics committees (RECs). One type of education activity involves multi-day workshops in research ethics. To be effective, such workshops should contain the appropriate content and teaching techniques geared towards the learning styles of the targeted audiences. To ensure consistency in content and quality, we describe the development of a curriculum guide, core competencies and associated learning objectives and activities (...) to help educators organize research ethics workshops in their respective institutions. The curriculum guide is divided into modular units to enable planners to develop workshops of different lengths and choose content materials that match the needs, abilities, and prior experiences of the target audiences. The content material in the curriculum guide is relevant for audiences in the Middle East, because individuals from the Middle East who participated in a Certificate Program in research ethics selected and developed the training materials (e.g., articles, powerpoint slides, case studies, protocols). Also, many of the activities incorporate active-learning methods, consisting of group work activities analyzing case studies and reviewing protocols. The development of such a workshop training curriculum guide represents a sustainable educational resource to enhance research ethics capacity in the Middle East. (shrink)

A growing number of contributors to environmental philosophy are beginning to rethink the field’s mission and practice. Noting that the emphasis of protracted conceptual battles over axiology may not get us very far in solving environmental problems, many environmental ethicists have begun to advocate a more pragmatic, pluralistic, and policy-based approach in philosophical discussions abouthuman-nature relationships. In this paper, we argue for the legitimacy of this approach, stressing that public deliberation and debate over alternative environmental ethics is necessary for a (...) culture of democracy to be upheld in decision making and policy formulation. Then we argue for a democratically tempered environmental ethics that is grounded in a practical understanding of the character of moral claims regarding the natural world. We offer the results of an empirical study of environmental ethics held by the public to illustrate the diversity in their moral commitments to nature. Finally, we conclude with a discussion of the implications of this ethical pluralism for policy discussions about the management of American public lands. (shrink)

Purpose At times, a traditional minority group that opposes a change in the patriarchal structure is violent toward women who wish to adopt modern lifestyles. This study aims to examine online comments regarding a shooting at a café in an Arab-Bedouin city in Israel, where women were employed as servers. The event was framed in Israeli media as an act of backlash by young men, who call themselves “The Modesty Guard.” Design/methodology/approach In this qualitative study, the authors collected 916 online (...) comments that were published on five main online news sites. A thematic and rhetorical analysis of online comments was conducted. Findings The findings uncovered five main themes: the expression of support for Bedouin women; ideas for dealing with the Modesty Guard; blaming Bedouin tradition for the shooting; comparison of the violent behavior to a parallel phenomenon among Charedim; and criticism of the lack of treatment by Israeli security forces. The responses reflected a supportive stance toward Arab-Bedouin women, who were open to progress. Conflict discourse, however, expressed alienation and increased social-national schism between the Jewish majority and Arab-Bedouin minority groups in Israel. Originality/value This study sheds light on the backlash phenomenon in Negev Bedouin society. Moreover, it exposes the lack of significant supportive actions and a lack of understanding of the deep processes unfolding in this traditional society. (shrink)

Many nonanthropocentric environmental ethicists subscribe to a ``principle-ist'''' approach to moral argument, whereby specific natural resource and environmental policy judgments are deduced from the prior articulation of a general moral principle. More often than not, this principle is one requiring the promotion of the intrinsic value of nonhuman nature. Yet there are several problems with this method of moral reasoning, including the short-circuiting of reflective inquiry and the disregard of the complex nature of specific environmental problems and policy arguments. In (...) the present paper, we advance an alternative, pragmatic contextualist approach to environmental ethics, one grounded in the moral theory of John Dewey. We present the results of an empirical study of public environmental ethics and natural resource management attitudes to support our position, and we conclude with a few recommendations for future inquiry in the field of environmental ethics. Bryan Norton 's convergence hypothesis, which predicts that nonanthropocentric and human-based philosophical positions will actually converge on long-sighted, multi-value environmental policy, has drawn a number of criticisms from within environmental philosophy. In particular, nonanthropocentric theorists like J. Baird Callicott and Laura Westra have rejected the accuracy of Norton 's thesis, refusing to believe that his model's contextual appeals to a plurality of human and environmental values will be able adequately to provide for the protection of ecological integrity. These theoretical criticisms (...) of convergence, however, have made no real attempt to engage the empirical validity of the hypothesis, the dimension that Norton clearly takes to be the centerpiece of his project. Accordingly, the present paper attempts to provide an empirical analysis of the convergence argument, by means of a study of the Vermont public's environmental commitments and their attitudes toward national forest policy. Our findings support a generalized version of Norton 's thesis, and lead us to suggest that environmental philosophers should try to be more inclusive and empirically minded in their discussions about public moral claims regarding nature. This book stems from an examination of how Western philosophy has accounted for the foundations of law. In this tradition, the character of the “sovereign” or “lawgiver” has provided the solution to this problem. But how does the sovereign acquire the right to found law? As soon as we ask this question we are immediately confronted with a convoluted combination of jurisprudence and theology. The author begins by tracing a lengthy and deeply nuanced exchange between Derrida and Nancy on the (...) question of community and fraternity and then moves on to engage with a diverse set of texts from the Marquis de Sade, Saint Augustine, Kant, Hegel, and Kafka. These texts—which range from the canonical to the apocryphal—all struggle in their own manner with the question of the foundations of law. Each offers a path to the law. If a reader accepts any path as it is and follows without question, the law is set and determined and the possibility of dialogue is closed. The aim of this book is to approach the foundations of law from a series of different angles so that we can begin to see that those foundations are always in question and open to the possibility of dialogue. A resolution must give “seeing it differently” a sense that makes it clear that it is seeing that one is doing differently and not something else that is going on at the same time. The Berlin school of gestalt psychology took the view that alongside the colors and shapes traditionally thought to compose the visual field was a similarly perceptible aspect of “organization”. Wittgenstein considers the possibility of a physiological explanation of aspect change. It focuses on Wittgenstein's writings on sensory aspects and non-sensory aspects. Cet article analyse la problématique de traduction du texte d’Ibn Rushd, Commentaire de la République de Platon, dans sa langue d’origine, l’arabe. S’inscrivant aux confluents du politique et du philosophique, cet ouvrage est un véritable traité politique. Le manuscrit, disparu probablement lors de la disgrâce qu’a connue Ibn Rush, nous est parvenu grâce à la traduction hébraïque de Samuel Ben Juda. Ahmed Chahlane et Mohamed A. al-Jabri se sont efforcés de restituer – à partir de l’hébreu – le manuscrit (...) dans sa langue d’origine. Après avoir précisé le contexte dans lequel est paru l’ouvrage d’Ibn Rushd et ses conséquences politiques pour l’auteur, l’article analyse la problématique de traduction en l’absence de l’original et tout particulièrement l’entreprise de restitution menée par Chahlane et al-Jabri. L’accent y est mis sur leur méthodologie de restitution et sur les annotations faites par Chahlane sur les traductions hébraïque et anglaises dont les approximations et les erreurs sont nombreuses. L’article démontre comment Chahlane et al-Jabri ont saisi le texte dans sa perspective originale et lui ont rendu sa structure originale en mettant à contribution l’œuvre d’Ibn Rushd et le corpus philosophique arabo-musulman. A review of theavailable literature would suggest that it is hard to find a piece of work thatconsiders the problem of corruption from all its theoretical aspects from anIslamic perspective or is exclusively dedicated to examining it from (...) to theperspective of the Qur’ān, Sunnah, or indeed both together. To fill this gap, thispaper is a thematic examination of the problem of corruption according to themain sources of Islam; i.e. the Qur’ān and Sunnah, through which an attemptis made to investigate the main theoretical facets in relation to understandingand tackling corruption. ABSTRACTAdopting a temporally distant perspective on stressors reduces distress in adults. Here we investigate whether the extent to which individuals project themselves into the future influences distancing efficacy. We also examined modulating effects of age across adolescence and reactive aggression: factors associated with reduced future-thinking and poor emotion regulation. Participants read scenarios and rated negative affect when adopting a distant-future perspective, near-future perspective, or when reacting naturally. Self-report data revealed significant downregulation of negative affect during the distant-future condition, with a (...) similar though non-significant skin conductance pattern. Importantly, participants who projected further ahead showed the greatest distress reductions. While temporal distancing efficacy did not vary with age, participants reporting greater reactive aggression showed reduced distancing efficacy, and projected themselves less far into the future. Nicht zuletzt der Krieg in der Ukraine zeigt die herausragende Bedeutung des Weltraumes für unsere Gesellschaft sowie die militärische Operationsführung im Allgemeinen. Bereits in 2019 wurde durch die NATO dieser Bedeutung Rechnung getragen, in dem der Weltraum als fünfte Dimension neben Luft, Land, See und Cyber anerkannt wurde. Die für den Weltraum notwendige Infrastruktur wird gemeinhin als kritisch betrachtet und fällt damit auch unter die Abschreckungssystematik der NATO. Der Beitrag diskutiert die Abschreckungspolitik der NATO im Kontext Weltraum entlang der zwei (...) vorherrschenden Paradigmen – deterrence by punishment und deterrence by denial. In der Folge wird diskutiert, inwieweit die Förderung einer tragfähigen Responsive Space-Mentalität und deren Umsetzung in anwendbare Strategien von wesentlicher Bedeutung für die Übertragung auf eine kollektive Abschreckungsstrategie der NATO sein wird. Reaktionsfähige Weltraumkapazitäten werden es allen Mitgliedstaaten ermöglichen, zu den kollektiven Verteidigungsanstrengungen des Bündnisses beizutragen und den Grundsatz der deterrence by denial zu stärken.
